Terms & Conditions

1. General. The following terms and conditions do not affect your rights as a consumer granted in English law

2. The laws of England shall apply.

3. All items are subject to availability and clinical suitability as deemed by the seller.

4. Explanation of Terms. From here in the term “customer” refers to you the buyer of products and/or services from rimless-glasses.co.uk. The term “seller” refers to the company, employees and contractors of rimless-glasses.co.uk.

5. Prescription. The customer is responsible for providing the seller with the correct details from the relevant prescription that will be applied and manufactured to the spectacles. All prescriptions must have been issued by a qualified and registered medical practitioner or a qualified and registered ophthalmic optician / optometrist.

6. All prescriptions must have been issued by the aforementioned (section 5) qualified and registered practitioner within the last two years.

7. The customer must be over the age of 17 at the time of ordering from the seller.

8. The customer must not be registered blind or partially sighted.

9. The customer must not place an order with the seller for spectacles for any person under the age of 17.

10. If the customer does not provide the seller with a pupillary distance/P.D./optical centers, then the seller will use an average measurement of 63mm for multi-use single vision, distance single vision and bifocal lenses. The seller will use an average pupillary distance of 60mm for single vision reading lenses. The customer can obtain a personalised pupillary distance measurement from a registered and qualified practitioner as described in section 5.

11. The customer is responsible for entering the correct prescription details and prescription lenses will be manufactured to this specification by the seller. The seller accepts no responsibility for a prescription that has been entered incorrectly by the customer. The seller for this reason will not accept returns.

12. If a customer is unsure about the relevant prescription or the prescription is illegible, then the customer must consult the registered practitioner as described in section 5 before placing an order.

13. The seller will not supply single vision spectacles where the spherical prescription is over +/- 8.00DS, the cylinder prescription is over +/- 4.00DC and the combined power must not exceed +/- 8.00D. The seller will not supply bifocal lenses where the spherical prescription is over +/-6.00DS, the cylinder power is over +/-2.00DC and the combined distance power is over +/-6.00D. The maximum reading addition supplied by the seller will be no more than 3.00D.

14. Cancellation/Amendment of Order. If the order is cancelled or amended by the customer before delivery of the goods, a proportionate fee will be charged by the seller. Any additional costs incurred by the seller with respect to the aforementioned cancellation or amendment of the order will be met by the customer.

15. Return of Order. The customer will have the right to return the completed order to the seller within a period of seven days after receipt of the delivery of the completed order/goods, the goods must be completely undamaged and in an un-used condition. The sellers policy is to refund the complete cost of the customers selected frame and associated free of charge products. The seller will not refund the cost of any extras that have been supplied at extra cost or carriage charges incurred by the seller or customer, on both an incoming and out-going basis. The original paperwork and a clear and legible original copy of the opticians prescription, photocopies or alike are not acceptable must accompany any spectacles returned by the customer to the seller.

16. Upon delivery of your completed order/spectacles you should inspect them fully. If any of the goods/spectacles are absent please inform us of the problem and do not use the goods/spectacles.

17. A printed copy of every order submitted by the customer to the seller will be contained within your delivered goods/spectacles package. If any part of the goods/spectacles does not match the order then please inform us of the problem and do not use the goods/spectacles.

18. Payment. Payment for any goods/spectacles must be made at the time of ordering and all payments must be in pounds sterling.

19. Ownership of Goods. Ownership of any goods/spectacles will pass from the seller to the customer at the time of delivery to the customers shipping address.

20. Re-sale of Goods. Goods are supplied to the customer by the seller on the condition that they are not re-sold in any capacity.

21. Company. Rimless-glasses.co.uk is the Internet trading name.
22. Recording of telephone calls. Telephone calls to the seller or by the seller may be recorded.

23. Pricing. The price of any goods or spectacles are clearly stated on our website or can be confirmed by our customer service team through e-mail or through the telephone.

24. The price stated for all goods and spectacles include any value added tax that is payable.

25. Delivery of goods / spectacles. Delivery will take place to the address entered by the customer only and must be a UK address.

26. Our standard delivery period is within 28 working days.

27. If the customer opts for express delivery (4 working days) this service is only available on single vision lenses. If for any reason the seller is not able to deliver the goods within the 4 working days time frame, then the additional costs incurred by the customer for the express delivery service will be refunded and the price for standard delivery will be charged. The customer is not able to cancel the order with the seller for this reason. The time frame of 4 working days begins on the receipt of the complete order from the customer. Working days are deemed to be from Monday to Friday 9.00am until 5.00pm and exclude public holidays and the sellers Christmas closedown period. In the event that an order is placed outside these periods then the first working day will be deemed from 9.00am on the sellers following working day. The customer must ensure that there is someone at the delivery address as specified within the customers order to take delivery and sign for the goods/spectacles.

28. If delivery to the address specified by the customer is not possible then the seller reserves the right to charge additional expenses incurred.

29. Limitation of the sellers responsibility to the customer. In no circumstances will the seller or it's employee's, agents or subcontractors be liable to you the customer for any business interruption, loss of use, loss of data, loss of profits, contracts, goodwill or anticipated savings.

30. Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury resulting from our negligence or any breach of the statutory implied terms as to title of goods or for fraud or any other liability which by law we are not permitted to limit or exclude.

31. Our maximum liability (and that of our employees, agents or subcontractors) to you in connection with any physical damage caused to your property through the negligence of us (or our employees, agents and subcontractors) will not in any circumstances exceed £10,000

32. In all other cases, our total liability (including our employees, agents and subcontractors) whether in contract, tort (including negligence) and breach of statutory duty or otherwise will not exceed the price of the goods and services to which the claim relates

33. The sellers responsibility. The seller will take every step to ensure delivery within the expected time frame. We cannot be held responsible for not being able to meet this obligation due to circumstances beyond our control, particularly if there are delays with our suppliers.

34. Personal contract. Any contract is personal between the seller and the customer. The customer may not transfer any rights of this contract to another person.

35. Sellers right to transfer the contract. The seller retains the right to transfer some or any part of the contract to any individual, company or firm.

36. Your personal data. The seller, it’s employees and sub-contractors will at all times adhere to the Data Protection Act 1998 and will only access the customers personal data in order to fulfill the customers order.

37. Communication between the seller and customer. Any communications between the customer and the seller regarding these terms and conditions are required to be in writing. Communications will either be by post, facsimile or by hand. For the purposes of post it is stated that delivery by first class post will be treated as being posted 3 working days before receipt. In the case of delivery by hand or facsimile then delivery is treated as immediate.

38. Use of cookies. The sellers website only uses one type of cookie called session cookies, which are temporary cookies that remain in the cookie file of your browser until you leave the site. The seller does not use persistent cookies.
